UPDATE: Ammunition Depot and Others Declare Legal Victory for California Gun-Owners

INFORMATION UPDATE

In a disheartening twist of events, on February 5, 2024, the 9th Circuit Court ruled that Californians' constitutional rights to access ammunition stand forfeited, issuing a stay on the esteemed Judge Benitez's decision rendered on January 31, 2024.

Despite this setback, the battle is far from concluded. Ammunition Depot remains steadfast in its commitment to collaborate with the California Rifle & Pistol Association, tirelessly advocating for the preservation of Californians' Second Amendment rights.

As of the current moment, the stay imposed by the 9th Circuit Court on Judge Benitez's decision is immediate, providing no elucidation on the reasoning behind this action.

In the absence of a comprehensive explanation, the uncertainty surrounding the situation only adds to the gravity of the circumstances.

Rest assured, Ammunition Depot is dedicated to monitoring and actively participating in the ongoing developments of this legal saga. We are resolute in our pledge to keep the public informed, providing timely updates as the situation unfolds.

The fight for safeguarding constitutional rights continues, and we remain unwavering in our commitment to the cause.

If you wish to purchase ammunition online, all orders must be shipped to registered FFLs, and we will need a copy of their FFL on file.

BOCA RATON, Fla.Jan. 31, 2024 /PRNewswire/ --

Marking a major victory for California gun owners and advocates of Second Amendment rights, a federal court in the District of Southern California today ruled to strike down the state's 2019 ammunition law requiring in-person background checks for every individual purchase of standard ammunition.

The decision comes after a knockout lawsuit—uniting the national online discount ammo retailer Ammunition Depot, the California Rifle & Pistol Association (CRPA), and Olympic shooter Kim Rhode, among others—and challenging the new process' excessive restrictions on law-abiding residents.

The court firmly sided with challengers in concluding that the state's policies fundamentally violated the constitutional rights of California's nearly 40 million citizens.

As highlighted by U.S. District Judge Roger Benitez in 2020, the law not only made California the only state in U.S. history to place such heavy restrictions on simple ammo purchases, but convoluted policies created widespread hassle and confusion for residents, visitors, vendors, and industry workers alike.

The state's background check system was also shown to be woefully ineffective—mistakenly blocking 16.4% of lawful ammo purchases due to various administrative errors and database issues—while only catching .03% of purchases that were accurately prohibited.

The new system was so impractical that millions of residents did not bother going through the process at all, with estimated forecasts showing a reduction of 95% in total ammo transactions for any given year.

"Like millions of gun owners, we share a deep appreciation for the freedoms guaranteed to us by our nation's constitution, and we were alarmed by the overt violations this system sought to infringe on second amendment rights for our country's most populous state," said Ammunition Depot CEO Dan Wolgin.

"We applaud the court's decision, and Ammunition Depot is proud to have joined Kim Rhode, the CRPA, and all others in this fight to protect the liberties we all hold dear as Americans."

Lead attorney for the Rhode case, Sean Brady of Michel & Associates, noted, "this particular background check system, instituted by California law, was so egregious and over the top that Judge Benitez never faltered in his determinations from his earlier rulings which gave gun owners a win.

Today's ruling reiterates that California's restrictions on ammunition purchasing are unconstitutional under yet another Supreme Court opinion with Bruen."

Ammunition Depot recognizes today's ruling as a victory for second amendment rights but urges all gun owners not to become complacent. Freedoms aren't usually taken away overnight; instead, they're slowly eroded over time.

It's up to all Americans to remain vigilant of laws that impose or undermine our rights and to take an appropriate stand when necessary.

Unfortunately, on the evening of February 5th, the 9th Circuit Court issued a stay on Judge Benitez's decision, and we had to stop accepting orders shipped directly to customers' doors in CA. We are extremely disappointed that Californians' constitutional rights are in limbo.

Dear AD, Under this new ruling, are California residents able to order ammunition and have it shipped directly to our homes? or are we still required to ship directly to an authorized FFL? I wasn’t able to find any updates on the CA-DOJ website about any ammunition updates or policy changes. Please advise John

Yes you can have it shipped directly to your home right now. This could change at any time though.
AMDEP John

What Randal said. We are shipping to your door for now. Hopefully, the CA DA's request for a stay on the court's decision is NOT granted, and we can continue helping you enjoy your constitutional rights!

AmDEP John

Unfortunately, I can't tell you for sure. Our lead customer service rep. told me it's taking 3 to 5 business days before orders get shipped due to the HUGE increase in volume, but that they've brought on another shift in our distribution center to help manage the times. Thank you!!!!

BIG Thank You to Ammo Depot in joining this fight and being a part of this win; no matter how temporary. I'm certain NEWSsome and that idiot Bonta will appeal this to the 9th Circuit and they will likely start the stall tactics but at least we have freedom to support companies like Ammo Depot for now! My order is in and hopefully I get it shipped before the window closes. You have my business for life!

Until today, I was unaware that Ammunition Depot took part in the lawsuit and supported this exceedingly important cause. Because of your hard work and dedication to the rest of us, I will look to YOUR company for all of my future ammunition purchases. It’s the least I can do for you and my way to say “THANK YOU Ammo Depot!”

Universal background checks "Yes" it will help keep guns out of the hands of some mentally ill and criminals. Stopping legitimate sportsmen from buying range ammo is a "No" and is taking things way to far.

AmDep John

I don't know how long it's taking to get tracking numbers, but our customer service manager told me it's taking 3 to 5 days for orders to ship from our distribution center due to the extremely high volume of orders we've been getting. If you need any tighter detail on the status of your order, reach out to customer service through the means on our website and they'll get you fixed up quickly! Thank you!

One wonders as to whether Judge Benitez’s ruling will survive likely appeal by the state, especially if such appeals are heard by The 9th Circuit Court, sometimes/often described as The 9th Circus Court.

Big thank you to Ammunition Depot for helping California resident get some of their freedoms back for a couple of days. Hopefully, the 9th circuit does what is right and restores our 2nd ammendment rights.

With Ca placing a stay on 020524, what happens with orders placed prior to the stay order? Will they still be sent/ delivered to Ca. Customers?
AmDep John

It's my understanding that if the order was placed before the stay, it's considered on the way.

It's no secret that C.A. is a welfare state and theses people will always vote Democrat because they dont want to loose there free handouts. So as a result the state is ran by Democrats and it's no secret that they want to take our guns so they can put there boots on our necks and control us without us being able to fight back. After all the 2A was written for Tyrannical government.
